Report: Hearing Officer in Medina Spirit Derby DQ Case Recuses Himself

Clay Patrick, the hearing officer assigned to the Bob Baffert-Medina Spirit Derby disqualification case, has recused himself three weeks after the appeal was heard, according to Paulick Report. Amr Zedan's attorney Clark Brewster unknowingly bought a horse at the Keeneland September Yearling Sale that was co-owned by Patrick, who operates the family-owned Ramspring Farm. Patrick was expected to make a recommendation on the appeal to the Kentucky Horse Racing Commission within 60 to 90 days. "After I bought the colt, I noticed how young the mare is and looked to...

Baffert Returns to Stand for Sixth and Final DQ Appeal Session

Just a few days short of exactly two years after her third-place finish and eventual disqualification in the 2020 GI Kentucky Oaks, Gamine (Into Mischief) was brought to the forefront once again when Hall of Fame trainer Bob Baffert made his second appearance on the witness stand during the final session of the Kentucky Horse Racing Commission's appeal hearing. Baffert originally filed the appeal that led to this six-day hearing to clear from his record a 90-day suspension that he has already served and to also reverse Medina Spirit (Protonico)'s...

Route of Administration Argument Continues in Day 5 of Derby DQ Appeal

The Kentucky Horse Racing Commission's hearing to address Bob Baffert's appeal came to a crossroad early in its fifth session on Monday in Frankfort, Kentucky following a three-day break over the weekend. After the KHRC closed their case at the start of the session, the appellants began their case by calling for a partial directive verdict in their favor based on their claim that the KHRC never proved how Medina Spirit (Protonico) received the betamethasone that led to his positive test and subsequent disqualification from his 2021 GI Kentucky Derby...

Baffert/KHRC Appeal Day 4: Ointment or Injection?

The debate over whether or not Medina Spirit's 2021 GI Kentucky Derby disqualification for betamethasone was the result of an injection or the application of an ointment was a focal point in the fourth day of testimony at Bob Baffert's appeal before a Kentucky Horse Racing Commission (KHRC) hearing officer in Frankfort, Kentucky, on Thursday. That argument has percolated for the better part of 16 months in various hearing and courtroom settings. It is now being brought up again in front of the KHRC hearing officer to adjudicate the Hall-of-Fame...

Getting Down to the Science of It All In Medina Spirit DQ Appeal

FRANKFORT, KY - After a brief private meeting between attorneys and the hearing officer to discuss "confidentiality" matters, the Kentucky Horse Racing Commission's hearing addressing trainer Bob Baffert's appeal continued, slowly but surely, on Wednesday in Frankfort, KY. While Tuesday's session focused on the KHRC's medication rules, along with those established by the industry's Racing Medication and Testing Consortium (RMTC) and the model rules of the Association of Racing Commissioners International (ARCI), the center of interest Wednesday was the corticosteroid betamethasone itself. The day started off with Dr. Heather Knych,...

KHRC Rules the Focus On Day 2 of Medina Spirit DQ Appeal

A deeper dive into the Kentucky Horse Racing Commission's rules defining what medications are considered prohibited versus those that are considered therapeutic and the standards for out-of-competition testing in relation to betamethasone as opposed to post-race testing were the hot topics during day two of the Kentucky Horse Racing Commission's hearing addressing trainer Bob Baffert's appeal Tuesday. Baffert filed the appeal to clear from his record a 90-day suspension he already served this spring, along with reversing Medina Spirit (Protonico)'s disqualification from his victory in the 2021 GI Kentucky Derby....

Baffert Takes Stand in Day One of '21 Derby DQ Appeal

Trainer Bob Baffert spent 2 1/2 hours on the witness stand testifying at a Kentucky Horse Racing Commission (KHRC) appeal hearing Monday. Baffert's intent by filing the appeal is to clear from his record a 90-day suspension he has already served while also reversing the KHRC's disqualification of Medina Spirit from the 2021 GI Kentucky Derby. Those penalties were the result of the Baffert-trained colt returning a positive for betamethasone after crossing the finish wire first in America's most historic and important horse race. Beyond the already-served suspension (which ran...

CDI: Baffert 'Broke Rules, Must Bear Consequences'

Just days after the one-year anniversary of Churchill Downs, Inc. (CDI)'s, ruling-off of trainer Bob Baffert over his repeated equine medication violations, the gaming corporation that controls the GI Kentucky Derby swatted back at the Hall of Fame trainer in federal court in an attempt to get a judge to dismiss a lawsuit initiated by Baffert that aims to reverse the two-year ban. "For the past eleven months, Bob Baffert has tried to dodge accountability for drugging Medina Spirit," CDI wrote in a reply brief filed June 6 in United...

Baffert, Zedan Again Denied Relief in KY Court of Appeals

Two weeks after a Kentucky Court of Appeals judge denied trainer Bob Baffert and owner Amr Zedan an "emergency" stay in their fight against the penalties levied against them by the Kentucky Horse Racing Commission (KHRC) over Medina Spirit (Protonico)'s betamethasone positive in the 2021 GI Kentucky Derby, a separate three-judge panel denied a motion for interlocutory relief that will keep the case from proceeding any deeper in that same court. The Apr. 15 ruling did, however, note that the judges' order was not a ruling on the merits of...
