National Rulings December 27 – 31, Carlos Acosta Banned 4 Years

Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA)-related rulings from around the country. The following rulings were reported on HISA's "rulings" portal and through the Horseracing Integrity and Welfare Unit (HIWU)'s "pending" and "resolved" cases portals. Among this week's rulings, trainer Carlos Acosta, Jr. has been banned a combined four years and fined a combined $25,000 after out-of-competition hair and blood samples taken in April from his trainees, Storm Leader and Tucum, tested positive for Albuterol, a banned bronchodilator. At the time...

Judge Denies Injunction In Serpe Suit Vs. HISA, But Leaves Door Open For Refile Of Key Seventh Amendment Claim

In a federal court case involving the Horseracing Integrity and Safety Authority (HISA) that is being closely watched because it involves a trainer's allegations of a wrongful denial of Seventh Amendment rights to a jury trial, a judge in Florida on Thursday denied conditioner Phil Serpe's request for preliminary injunction in a lawsuit initiated last October against the HISA and the Federal Trade Commission (FTC). The civil complaint involves "banned substance" sanctions stemming from the alleged detection of clenbuterol in an Aug. 10, 2024, Saratoga Race Course winner from the...

Serpe Clenbuterol Case Reaches Legal Inflection Point

In its ongoing case against Philip Serpe for a Clenbuterol positive stemming from last August, the Horseracing Integrity and Welfare Unit (HIWU) will not pursue a fine against the trainer--what could have been a $25,000 penalty--as per a letter issued by the agency last week. Serpe, however, argues that this action was taken by HIWU to prejudicially stymie his legal efforts in a federal court case against the Horseracing Integrity and Safety Authority and the Federal Trade Commission (FTC), which includes the contention that he has been wrongfully denied his...

FTC Affirms Wong Suspension and Fine, Case Heads to Federal Court

The Federal Trade Commission (FTC) has affirmed an earlier Horseracing Integrity and Safety Authority (HISA) arbitration panel ruling against trainer Jonathan Wong, suspending him for two years and fining him $25,000 for a 2023 post-race metformin positive. Metformin is a type 2 diabetes drug that HISA has classified as a banned substance. With more 20 million patients taking it, metformin ranks as the nation's third-most-prescribed human medicine, according to the consumer healthcare website Healthgrades. Before Lauer's case made it to an official arbitration hearing, the 72-year-old conditioner with five decades of licensure was able to present enough evidence to the Horseracing Integrity...

"The system worked and we are happy to clear his good name and his reputation," Mollica said. Mollica said HIWU's decision came about after a review of the split sample, which was requested by Mollica and Farrior. Mollica...
