Weekly National Regulatory Rulings – Jan. 30 – Feb. 5

Every week, the TDN posts a roundup of the relevant Horseracing Integrity and Safety Act (HISA) related rulings from around the country.

The following rulings were reported on HISA's “rulings” portal and through the Horseracing Integrity and Welfare Unit's (HIWU) “pending” and “resolved” cases portals.

 

Resolved ADMC Violations

Date: 02/04/2025

Licensee: William Pribble, trainer

Penalty: 18-month period of Ineligibility for Covered Person, beginning on August 21, 2024; a fine of $12,500. Admission.

Explainer: Violation of Rule 3216(c), “Prohibited Association” with Adolfo Macias. While there is currently no public explanation in HIWU's case against Pribble, Macias is currently serving a three-year ban for possession of a banned substance (Levothyroxine), and for caring for Pribble's horses at the Triple Diamond Training Center in Lexington in violation of the stipulations surrounding his period of ineligibility.

Licensee: Howard Rubin, trainer

Penalty: A fine of $500; imposition of 1.5 Penalty Points. Final decision of HIWU.

Explainer: Vets' list medication violation for the presence of Methocarbamol-a controlled substance (Class C)-in a sample taken from Midnight Metal on 11/24/24.

 

Date: 01/31/2025

Licensee: Juan Silva, trainer

Penalty: Disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $500; imposition of 1.5 Penalty Points. Admission.

Explainer: Medication violation for the presence of Methocarbamol-a controlled substance (Class C)-in a sample taken from Mt. Zeror, who finished second at Turf Paradise on 12/17/24.

 

Date: 01/31/2025

Licensee: Juan Arriagada, trainer

Penalty: A period of Ineligibility of fifteen (15) days, starting February 1, 2025; disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $1,000; imposition of 2 Penalty Points. Final decision of internal adjudication panel.

Explainer: Medication violation for the presence of Acepromazine-Controlled Medication (Class B)-in a sample taken from Alexa's Dream, who won at Delaware Park on 5/22/24.

 

Date: 01/29/2025

Licensee: Michael Simone, trainer

Penalty: Disqualification of Covered Horse's Race results, including forfeiture of all purses and other compensation, prizes, trophies, points, and rankings and repayment or surrender (as applicable); a fine of $500; imposition of 1.5 Penalty Points. Final decision of HIWU.

Explainer: Medication violation for the use or attempted use of a Class C controlled medication on Viking Queen during the race period.

 

Date: 01/29/2025

Licensees: Flint Stites, Jamie Ness, Brandon Kulp, Miguel Rodriguez, trainers

Penalty: N/A

Explainer: The alleged TCO2 cases issued against the above trainers-six cases in total spanning 1/19/24 through 3/25/24-were withdrawn due to a lack of consistency in testing methodology at the Pennsylvania Equine Toxicology and Research Laboratory when compared with the other laboratories used by HIWU.

PENDING ADMC VIOLATIONS

02/05/2025, Donna Kutt, trainer: Pending medication violation for the presence of Phenylbutazone-Controlled Medication (Class C)-in a sample taken from Bivol, who finished fifth at Tampa Bay on 12/29/24.

02/05/2025, Jeff Hudson, trainer: Pending medication violation for the presence of Phenylbutazone-Controlled Medication (Class C)-in a sample taken from Go Water, who finished fourth at Zia Park on 12/02/24.

 

02/04/2025, Raymond Valerio, trainer: Pending medication violation for the use or attempted

use of a Class C controlled medication on Crypto Conspiracy during the race period.

 

02/03/2025, Christine Hicklin, trainer: Pending violation for “Possession of a Controlled Medication Substance or Controlled Medication Method not in compliance with applicable State or Federal law” for an event dated 9/19/24.

 

02/03/2025, Jon Glenn Arnett, trainer: Pending medication violations for the use or attempted

use of a Class C controlled medication on Blessed Anna during the race period, and for “Possession of a Controlled Medication Substance or Controlled Medication Method not in compliance with applicable State or Federal law” for an event dated 9/28/24.

 

01/31/2025, Juan Munoz Cano, trainer: Pending medication violations for the presence of Capsaicin-Controlled Medication (Class B)-in a sample taken from Iceatude, who won at Churchill Downs on 11/15/24, and Voodoo Zip, who won at Churchill Downs on 11/16/24.

 

01/31/2025, Dr. Benjamin Bealmear: For the possible possession of Adenosine Triphosphate (“ATP”) for an event dated 10/3/24. This is a possible violation of Rule 3214(a)-Possession of Banned Substances.
